That's what the birthers don't quite get. They don't have the power of fiat. They are demanding extra steps be taken, the burden of proof is on them.

To make matters even worse (for them), the lawyers that are "advancing" this cause are woefully inept. The lawyers keep getting smacked down in court for simple civil procedural errors (i.e. improperly serving a defendent). Said lawyers then run to the birthers and claim that it's all a giant conspiracy. The birthers buy it us, because of their ignorance. If they'd bothered to research the matter, they would see that their lawyers have fucked up yet again.
