But in this school it was. Kids were not wearing flag shirts out of patriotism but to provoke an incident with other students. In this case (not ALL schools) the principal thought that it was necessary to ban them in the interests of safety......the court agreed

Neither you nor a judge can know the internal motivation of every student at a given school who chooses to wear clothing that represents the colors or image of the American flag. If there is some question, if there is a side to err on, it should be the freedom of expression of American students and the display of American patriotism. If something has to give in this case (and nothing does, really) it should be Cinco de Mayo. All this is another example of a public school where those in charge cannot do their jobs while exercising common sense, and a lefty judge intoxicated by PC bullshit.

Wearing an American flag shirt on Cinco de Mayo is free speech, whether it was intended to offend or not. So is showing up to an NAACP rally in white sheets. You are welcome to call people assholes for doing it. That's protected under free speech as well. But banning it outright is where the line should be drawn. This ruling is bullshit.
