Abbott made the declaration in late July. They sued about two months later in late September, about 2-3 weeks before early voting actually began. They might have had a chance if they sued right after the order came out.the time it took the GOP to file it, i believe.

Give me a break. That makes zero sense. The dates in question are part of the material language of the law as passed by the Texas legislation. According to Paxton, those laws can only by changed by the state legislation, not by the governor regardless of an emergency declaration.
