There are good reason to ban incestuous marriages. Incestuous marriages lead to a high probability of congenital birth defects and narrow the gene pool which is damaging to society. The only reason to ban gay marriage is for religious reasons which should not be of any interest to the state. In fact, gay marriage has some very positive benefits for society. It certainly helps reduce overpopulation. Marriage makes people on average, healthier, happier and wealthier. For a couple raising kids, marrying is likelier to make them healthier, happier, and wealthier, too. Marriage is our best line of defense against financial, medical and emotional meltdown.

So only beneficial legislation gets credited to Republicans, in spite of who's in the White House. Conversely, legislation overturned in the courts gets pinned to Democrats, in spite of the circumstances. Got it. Consistency, the hallmark of a true champion (my High School track coach said that)

I agree, it is a state issue, not a federal issue, just like the Immigration issue in Arizona and the Marijuana issue in California.

I believe the "issue" (such as it was) boiled down to a concern that if State "A" says a "marriage" is solely between a man and a woman, but State "B" says no no, a "marriage" can be between a man and a man or a woman and a woman, then because of the Full Faith and Credit obligation, State "A" will have to accept the "determination" of State "B."

So the DOMA law was designed (I believe) to make sure that marriage laws remained the province of each individual state.

Accordingly, if the SCOTUS reverses the lower court, this time, it could be legitimately argued that they would be engaged in genuinely conservative jurisprudence.

I wish ALL states would get OUT of the business of classifying the social contract between adults as "marriage." That should be the province of churches and synagogues, etc., not the province of the States. As far as the STATE is concerned, it should ALL be just a civil union contract. If a gay couple cannot get "married" in the Catholic Church, that is not a matter for the secular courts.


DOMA actually had two separate sections:

1. Under Congresses Article IV Section 1 authority relieved state for having to recognize one type of Civil Marriage based on gender.

2. Defined for federal purposes what a Civil Marriage was.​



If I'm reading the OP article correctly, #1 was not addressed by the Appeals Court. It was #2 that was at issue and only that piece was ruled unconstitutional.
