This is the right decision. It comes down to intent. Maybe Colbert's people went a little too far but they did not cause violence such as Jan 6 where 141 police officers were injured and many seriously and one dying as a result. Intent is important in any prosecution. There is nothing analogous to what Colbert's staffers did and what the Jan 6 terrorists did.
