Fired deputy lied about violation to make a traffic stop, attorney said

The St. John the Baptist Parish Sheriff's deputy who was arrested Wednesday (April 8) after authorities say he perjured himself during a pre-trial hearing in October in connection with a massive marijuana bust on Interstate 10, lied on the witness stand when he characterized the traffic stop as "random" and testified that the driver was pulled over because he "swerved across the center line," a defense attorney said Wednesday.
According to the sheriff's office, more than 120 pounds of marijuana and $18,000 in cash was found stashed in cans and boxes inside the vehicle following the traffic stop on July 12, 2014.
The driver, Adam Landry, and his fiancé Miranda Davis were arrested and booked on several illegal drug charges.
However, the couple's defense attorney, David Belfield, said the inconsistent testimony that Deputy Cody Malkiewicz gave under oath on Oct. 9, led to the dismissal of the case on Feb. 3 by the St. John District Attorney's Office.
The following day, 30-year-old Malkiewicz, a nearly four-year veteran of the St. John force, was fired, according to the Sheriff's Office.
Belfield said Sheriff Office audio recordings of the deputy's radio conversations about the traffic stop that day, contradicted the sworn testimony Malkiewicz gave during the hearing at the Edgard court house.
"The whole story he made up about the stop while on the stand all turned out to be a lie," Belfield said. "He lied on the witness stand. Landry didn't cross the centerline. It was a designated, preordained stop," based on a tip.
