While he may not have been allowed to hold onto the documents after he left the position of VP (should have returned them when he left, yeah, I said it), he WAS allowed to see them and determine the classification. Found the EO for you, here's the link.............

Here is the part where he has classification authority:

And here is the part that includes his being able to declassify things (if he was the one that made it classified)...........

Joe had classified documents which was illegal for him to have and they were all over the place in boxes in his fucking garage and at Penn state which is funded by the CCP... he sent in his lawyers without security clearances to find them.... no FBI raid... no headlines of treason like there were when Trump's documents were taken....

First off, the place that Trump had his documents was not considered secure for classified information. Second, the SS is there to protect Trump, not the documents. And third, Trump had a hell of a lot more documents than Biden did.
