But the ruling wasn't saying that he shouldn't be punished but rather that his constitutional rights were violated in this case. That's what this judge was ruling on and that's what we need our judges to do. Not to be emotional and to review the case and to see whether the person's constitutional rights were violated.
I am not in the case so I can't determine what the ruling was based on so I would have to read the opinion (which no news outlet ever linked to) to see what the standard of review was.
