LOL. The moron judge (and his name rhymes with moron) claims MAL is worth as little as $18 million when far smaller houses/properties are for sale for $40 million plus in the area.

These homes are about 1/30th the size of Mar-a-Lago, not on the beach (let alone the beach and Intercostal), don’t span from once side of the Palm Beach Island to the other… it is a travesty of justice and an embarrassment to the court.

What is Prosecutorial Discretion?

Disadvantages of Prosecutorial Discretion

". . Probably the biggest downside of prosecutorial discretion is that it creates the potential for prosecutorial misconduct that can be seen in cases of selective prosecution. Because of the inherent subjectivity of a prosecutor's discretion, their personal beliefs and biases - whether conscious or unconscious - can creep into their decisions. This can lead to prosecutors filing charges based on a defendant's race or social status.

Selective prosecution isn't just a societal problem, it's actually a violation of the Equal Protection Clause of the Fourteenth Amendment to the U.S. Constitution. In fact, a defendant can use it as a defense, although it can be difficult to prove. In order to succeed, the defendant must prove that the prosecutor's policy:

  • Was motivated by a discriminatory purpose
  • Had a discriminatory effect
In proving a discriminatory effect, the defendant would need to show that similarly situated individuals of a different race, class, etc. weren't prosecuted for the same or similar crime. Given that most cases have a unique set of facts, there are any number of ways that a prosecutor could argue that certain facts warranted prosecution while others did not.. . . "

Trump has been inflating his assets by some 400% for years, that's illegal.

Even if others have been doing it and have been getting away with it, that doesn't mean he's innocent. Thing is, the NY DA prosecutes fraud cases all the time, so there is no 'selective prosecution'.

Great quotes:

New York Supreme Court Justice Arthur Engoron also ordered the cancellation of Trump business certificates and imposed sanctions on attorneys representing him, two of his adult children, two other company executives and the business for repeating arguments that failed multiple times previously and were called “borderline frivolous.”

The judge’s ruling represents a significant setback for Trump by restricting his ability to do business in New York, where the Trump Organization is headquartered and where Trump has major real estate interests. It also represents a victory for Attorney General Letitia James (D), who had asked that Engoron simplify the upcoming trial by deciding in advance that fraud was broadly committed so the state would need to prove only specific illegal acts.
