They were not illegally recording him. They were recording Kislyak, legally, because he is a foreign agent and therefore they can get a FISA warrant to collect intelligence on him. So yes, they had recordings of Flynn talking to Kislyak, but no it was not illegal.

Furthermore, I think Flynn knew this was out of bounds with respect to foreign policy. He knows that there’s only one president at a time. The revelation that he was engaging with Russia in foreign policy before taking office, especially in a manner that was deferential, would be bad publicity.

They didn’t need Flynn to lie. He did that all on his own.
