Model Prosecution Memo for Trump Classified Documents

... the Obama Foundation website, the Foundation agreed “to transfer up to [$3.3 million] to the National Archives Trust Fund (NATF) to support the move of classified and unclassified Obama Presidential records and artifacts from Hoffman Estates to NARA-controlled facilities that conform to the agency’s archival storage standards for such records and artifacts, and for the modification of such spaces.”

The letter goes on to state: “The first transfer of $300,000 was already made on August 9, 2018. An additional interim transfer will be made within 180 days of that date. Subsequent payments are subject to the negotiation of terms of the digitization process and museum operations.”

The Obama Foundation rented an abandoned warehouse from Hoffman Estates for the purpose of storing the documents, the Daily Herald reported, and last month extended the original lease to 2026.

Did Biden attempt to obstruct the return of those documents?

Nope!

Did he brag to unauthorized people about those documents and tell them the contents?

Nope!

Did he deliberately hide classified documents when asked to return them?

Nope!
Why did Biden steal the documents in the first place? And you give him a pass for...

44 U.S.C. § 2205(3)

(3) the Presidential records of a former President shall be available to such former President or the former President’s designated representative.

So, much ado about nothing, thanks to Reichsleiter Garland.

See, this is why the actions of Reichsleiter Garland and his attack dog Jack Smith are so political in nature.

A former President has more rights to his Presidential records than the MSM and the DoJ want Americans to know.

Trump's lawyers met with the Justice Department today to beg the DOJ not to prosecute their client. Due to the surfeit of evidence of Trump's crimes surrounding classified documents, it is highly doubtful the attorneys succeeded in their mission.

Below is an analysis of what a prosecution memo will look like.

Before indicting a case, prosecutors prepare a prosecution memo (or “pros memo”) that lays out admissible evidence, possible charges, and legal issues. This document provides a basis for prosecutors and their supervisors to assess whether the case meets the standard set forth in the Federal Principles of Prosecution, which permit prosecution only when there is sufficient evidence to obtain and sustain a conviction. Before a decision is made about bringing charges against Trump (and co-conspirators, if any), prosecutors will prepare such a memo.

There is sufficient evidence to obtain and sustain a conviction here, if the information gleaned from government filings and statements and voluminous public reporting is accurate.

Our memo analyzes six federal crimes in depth:

Mishandling of Government Documents
1. Retention of National Defense Information (18 U.S.C. § 793(e))
2. Concealing Government Records (18 U.S.C. § 2071)
3. Conversion of Government Property (18 U.S.C. § 641)

Obstruction, Contempt, False Information

1. Obstruction of Justice (18 U.S.C. § 1519)
2. Criminal Contempt (18 U.S.C. § 402)
3. False Statements to Federal Investigators (18 U.S.C. § 1001)

Two of the authors of this model prosecution memo, Norman Eisen and Fred Wertheimer, were among the counsel for amici supporting DOJ’s position in litigation before the U.S. District Court for the Southern District of Florida, and the U.S. Court of Appeals for the Eleventh Circuit, related to the criminal investigation mentioned in this report.

The Biden team is absolutely corrupt.

Does "equal justice under the law" mean anything to you?
Oh sure it does. Just like a duly issued subpoena means something.
----------------------------------------------------------------------------------------------------------

Negotiations are the norm. Understand the word 'negotiate'?

Oh sure, folks understand that.
As they do for the the word 'subpoena'?

---Trump says he declassified Mar-a-Lago documents---

Can he, has he.....proved he declassified such documents?
If he cannot show who or how he communicated that X-document was de-classified, then.......
....then the document remains classified until a specific protocol has positively and with purpose occurred .......... and been communicated.

And it must be that way. Too many people can be in harms way if secrets are unguarded. Duh!
America cannot have some POTUS who has a stroke that mentally impairs then imagine he can give away all our secrets.
Our secrets are secret for a reason. And our common sense tells us that we must guard our secrets.
Guard them from thieves, spies, the careless or incapacitated handlers of those secrets.

From a lecture on "National Self Interest"......by Captain Obvious.

Not sure if you've heard, but Joe Biden has left classified documents unsecured all over the country. Does "equal justice under the law" mean anything to you?
Biden didn't lie about having them, and then obstruct their return.

They were found and immediately turned over.

Oh boy, looks like SENATOR BIDEN might be in big trouble if this GASLIGHT THEATRE BULLSHIT goes forward. 🙄
FYI, as a Senator on the Foreign Relations Committee, Biden did have classified clearance...

(Not to take the crap home with him, though)

I did read that both Biden and Pence classified documents were found in boxes packed from when they left office....they could have been packed by mistake, or unknowingly by both of them.

Of course they can convict, along with Obama, Biden, Pence, and many others. The question is, are they only going to prosecute one person instead of everyone?

Works for me.

Trump's conduct was a lot more egregious.

But getting Trump on this is like getting Al Capone on income tax evasion. You know that he's done much worse stuff, but this is the path of least resistance.
