Mueller's job was not to indict the President. Mueller's job was to investigate and report. Mueller could have easily stated the President obstructed Justice, that it was his and his team's assessment that the President Obstructed Justice. Comey's job was to report findings. Instead, as the US IG stated, he 'usurped the power / authority of the US AG / DOJ by making the decision that Hillary would not be indicted.

Mueller had the opportunity to make the declaration that the President had obstructed justice. He did not.

The 2nd half of his report was Mueller 'testifying' / was commentary AFTER HAVING ISSUED A DECISION.

Mueller failed to prove guilt / refused to make the decision / declaration that the President had obstructed justice.
