Comey being a citizen cannot state it was obstruction of Justice--he is just going to testify what happened--what was said by Trump--and the legal eagles--congress--and the special prosecutor will be the ones that will decide if it was Obstruction of Justice or not. If Comey is asked--in your mind--is this Obstruction of Justice--he will refuse to answer that question.

Since this investigation has turned into a Criminal Investigation--there's really not a lot anyone can say. However, since Trump has publicly attacked James Comey--either on T.V. or via his tweets--he cannot claim Executive Privilege. Comey has already met with Robert Mueller, the special prosecutor and has been briefed on what he will be able to answer and what he won't. If the question comes up--"Do you believe that Trump was trying to interfere or obstruct justice"--Comey won't answer that question, since this investigation is in the hands of Robert Mueller. Mueller will answer that one eventually.
