police arrest, assault family for refusing to open home for stakeout.

-Henderson police officers arrested members of the Mitchell family they believed were communicating the position of a SWAT team to a barricaded armed suspect.

- Police said Michael Mitchell on three occasions used his cell phone to communicate law enforcement positions to Phillip White, Jr., the target of the domestic violence investigation. The two men were friends, police said.

-Officers said Michael Mitchell also set off his car alarms to “distract, annoy, and obstruct the emergency response” and refused to comply with their commands to stay inside his home

-A North Las Vegas police report showed Anthony Mitchell had extended his middle finger toward the officers and was taking photos or video of the officers positions. North Las Vegas SWAT assisted Henderson police in the case.

Mitchell is far from an innocent bystander protecting his property rights. He was actively involved in interfering with a police action and putting their lives at risk. I see why he waited two years to file this frivolous case

Funny how when you get the details, the complexion of the story completely changes.

The burden of proof is on the cops.

Did they merely suspect or "believe" that Mitchell did these things or can they prove it?

The citizen does not have to prove he did nothing wrong in our country.

1. They were in such a hurry that they demanded he let them in,went back got into combat gear came back assaulted him and his home and animals, took him to command HQ then came back...doesn't sound like a very urgent case there
2.So what? That's his right to talk on a phone if he wants to...how the fuck they know who he was talking to? I say they are lying...and even if he did its none of their fucking business what he does in the privacy of his home. Again I guarantee they are lying.
3.First they say they wanted him out of the house so they could take it over now they claim he wouldn't stay in the house....damn their lies keep digging this hole deeper and deeper
4.Nothing wrong with flipping pigs off or video taping them especially on private property or from a public area.Pigs are known for assaulting people who do this though..

So yes in review he was protecting his rights and his home from armed assailants who happened to have a badge on so they think that grants them extra rights.

I'm told this incident took place in Las Vegas, NV, which is just 17 miles from Henderson, NV. So it seems the police in that part of America have a very different orientation from that of the rest of the Nation's police. More like the old KGB.

I don't know what the subject of that vicious attack did but he seemed fairly passive. What the cop did could have caused serious injury -- even death if the subject's head hit the pavement. And because there were two cops, such a viciously aggressive attack was absolutely unnecessary.

Video: Old TV Clip Of The Week: Las Vegas Cop Choke Slams A Man! "Get Ya Hands Out Yo Muthaf*ckin Pocket"

Supposedly was a fight, pig orders civilian to put hands on car man doesn't listen to orders gets assaulted.

Somalia looking better to you, yet?

Without knowing the details, basically when an officer of the law says do something, you do it. They aren't making "requests". And they are the ones putting their lives on the line, especially in a state which allows concealed carry.

Prison cell looking better for you? I mean its the one place the authorities control everything you do! You should love it!

Oh and no when a pig orders you to do something you don't have to listen, that badge is nothing but a piece of metal it doesn't grant you any extra rights or authority. Like I have always said pigs are the kids in school who were picked on so they grow up to become a pig and harass and assault innocent people.

The cops have not charged Mitchell
The burden of proof shifts to Mitchell to prove his lawsuit. So far, it seems to misrepresent the actual facts of that day and will get thrown out

By not charging him they sealed their fate.

He did nothing wrong but his home was still invaded and he was still brutalized sans warrant.

Unless the cops are denying that they broke down his door assaulted him and dragged him away in cuffs without a warrant the proof they did so is already there.

So now Mitchell is claiming the cops were too lenient with him?

Mitchell sat on this thing for two years. If he were so outraged over the incident, he would have filed immediately. He just got himself an ambulance chasing lawyer who is promising him a windfall for his own bad behavior

If the statute of limitations for filing was still in effect it doesn't matter.

If they didnt end up charging him what was the point of breaking into his house, detaining him, and terrorizing his family.

The charges of aiding the person in the domestic dispute reeks of post facto ass-covering.

The fact is we have basically made police immune from the consequences of mistakes. This, along with the progressive desire to see them as the only armed people besides criminals smacks of the creation of a new class of knights, are arm-bearing betters to protect us from ourselves.

Easy enough...

Have Mitchell explain his actions on that day and let the police explain theirs

In the meantime, lets dispense with the nonsense of the OP that Mitchell was just an innocent civilian, minding his own business when the Nazi police broke down his door and took over his house

Or we can give the benefit of the doubt to him, instead of a police force that basically shat on our consitutional rights.

-Henderson police officers arrested members of the Mitchell family they believed were communicating the position of a SWAT team to a barricaded armed suspect.

Because those police believed Mitchell was communicating with his neighbor they forcibly invade his home and assault him? They later searched phone records and learned what they'd believed was in fact not true.

Because I regard you as one of the more sensible and intelligent participants in this forum your position in this situation surprises me. While it's possible these Mitchells are a family of low-lifes, I operate on the assumption that what the police can get away with doing to them could someday reach to me. So it's best to nip it in the bud.

- Police said Michael Mitchell on three occasions used his cell phone to communicate law enforcement positions to Phillip White, Jr., the target of the domestic violence investigation. The two men were friends, police said.
Phone records disprove that.

-Officers said Michael Mitchell also set off his car alarms to “distract, annoy, and obstruct the emergency response” and refused to comply with their commands to stay inside his home
So arrest him while he's outside -- and then prove in court he was doing what is alleged.

So what?

Were these police conducting a SWAT operation to take down a notorious terrorist organization or armed bank robbers? Because they make it sound that way. I've heard they were responding to a domestic violence situation. I haven't even heard there was an armed standoff.

Mitchell is far from an innocent bystander protecting his property rights. He was actively involved in interfering with a police action and putting their lives at risk. I see why he waited two years to file this frivolous case
If your suspicion were at all valid you may rest assured all charges against Mitchell would not have been dropped. Whenever that happens you may rest assured the charges were unsustainable bullshit.

Again, this Mitchell might be a first class scumbag. But what the cops do to him today and get away with they will do to you tomorrow.

Guy, everytime you get on here with the crazy talk, I think you need to be protected from yourself.

Or at the very least, the rest of us need to be protected from you.

He's fine with that. He is a natural-born boot-licker. It would be funny if it weren't so sad.

No, I have a reasonable concern about people who spend all their lives fantasizing about shooting people.

I spent 11 years in the Armed forces, and didn't spend as much time fantasizing about firing a gun in anger at another person than you do in a given week.
