He should have known better...he is a law officer...doesn't matter how distasteful you find something if its not harming someone on private property not jack you can do about it.

my brother-in-law said he couldn't park a small shop van in his drive way
and this was not a gated community..just a regular suburb area

It depends on the agreement you signed. I think they could legally make you take the flag down, but I really don't know because I would never agree to other people telling me what I can do on my property that was not illegal.
