If they have been declassified there is no issue with stating so. Trump did. Now granted I can understand why his lawyers do not want to as they know they have not been.
 
If that's their claim, Trump had no idea the document(s) were re-classified unless somebody told him.

By the way...in the "butter emails" case...Clinton's emails were classified AFTER the fact...and Comey claimed that because of the nature of them she should have known that the material was classified.

You don't know that. The only thing reported is that ENVELOPES were marked classified. It doesn't mean the contents were. He could have declassified them and not made out new envelopes yet.

The government doesn't vs. the president, either. Biden really can't just give away the power of the executive privilege to the FBI's discretion like he allegedly did. He may be subpoena'd and questioned on that if anything goes to court. That could get interesting.

Trump's lawyers arent the ones who need to make factual claims. If they feel that the prosecutors have enough evidence to convict Trump in the absence of a claim of declassification, they will put on as many witnesses as they have that he did so.

Of course that is in the fantasy world in which Trump is actually put on trial after being indicted. Grand juries are noted for indicting whoever prosecutors ask them to, but the DOJ seems uninterested in giving Trump a third win at trial.

Correct, the President does, and he was President at the time he declassified the documents.
