I'm no constitution expert but I can say it's definitely wrong, especially when we claim we want everyone to be equal.

If you give one business special treatment just because the owner is a specific skin color that means you aren't giving the same treatment to all the other skin colors which by it's very definition is racist, it's also unequal and unfair.

Just like a company hiring specifically blacks or a school admitting specifically blacks then you're putting other skin colors at a disadvantage.

If everything was fair and equal then there would be no benefits for minority businesses. They would have to depend on their insight, skill, ambition, experience and intelligence just like everyone else does. Truly fair means you succeed or fail on your own.
