The victim's father here is a COP in a nearby town. The victim had previously been stopped and illegal MJ found in the car, so the local cops were following and harassing the kid prior to this event.

Kid and father (Matt) had had a very recent detailed discussion about how to respond when pulled over - on a bullshit pretext. The father emphasized to the kid that the POLICE HAD NO RIGHT TO SEARCH THE CAR without either a search warrant or pursuant to a lawful arrest. This is why the kid kept asking the cop if he was under arrest, and if so, why? If not legitimately under arrest then the cop has no right to remove him from the car or search the vehicle. And obviously, here the stop was for NOTHING AT ALL.

THE KID WAS DOING EXACTLY WHAT HIS POLICEMAN-FATHER TOLD HIM TO DO!

While the cop is an ass-hole and deserves the jail sentence that he got, Taser is in big trouble, and is largely the cause of much of the attention drawn to the case. Taser KNEW for many years that Tasing someone in the chest could cause cardiac arrest, but they intentionally left that off their training materials, so cops were not aware of this possibility. In fact, Taser's sales reps were telling the police that cardiac arrest could occur spontaneously, unrelated to the device.

This obnoxious cop was under the false impression that the kid was awake and conscious, but "passively resisting," and the cop had no way of knowing that he was actually unconscious due to cardiac arrest. Had he known the kid was unconscious, one can only presume that he would have treated the situation differently (and not dropped the kid on his face on the pavement).

The kid suffered permanent brain damage due to the prolonged period of cardiac arrest (not due to the head injuries), but is now reasonably functional; he will never go to college. Taser will be the main defendant in the coming lawsuit(s), for intentionally failing to notify police of the inherent dangers of their device, when the suspect is shot in the chest.

Sometimes stupid comes with a big price. No he didn't deserve it, no more than someone deserves to get hit if they play in traffic you run your risks when you cause problems.

I don't believe the dad told the kids that, being an officer he would know you can remove someone from a car, that's how sobriety tests are conducted, not in the vehicle.
 
The kid just stood up for his rights. He wasn't told what the stop was about and the cop was one of those "you better do what I tell you because I have all the authority even when I give you unlawful orders" types who infest police departments. The cop had no right whatsoever to drag the kid out of the vehicle and absolutely no right to use taser on him. He did not charge the kid with any wrong doing just went about to be a bad ass to satisfy his own power hungry ego.
 
The cop didn't want to talk through a closed window. The kid refused to lower it so he started the problem.
The kid rolled the window down enough to be able to talk to the cop. Where does it say you have to roll your window all the way down when you can communicate just fine with a partially rolled down window?
 
sad people (ice) say he was stuck on stupid for exercising his rights......you have the right to question cops and ask what is going on...why should he get outta the door ..the cop was just pissed and used his taser to be a bully and some kid pays for it....
 
The window was NOT closed. It was open half-way. And if we could hear the kid on the fucking video, then it is clear that the cop could hear him as well.

There is only one person who started this problem, and one person responsible. If you don't see who that person is, you are pretty much not worth responding to.
