Trying to Bar Trump From 2024 Ballot Is Unconstitutional and Lawfare at Its Worst

Actually he was. Charged, tried and acquitted. (2nd impeachment).
He was not acquitted by a jury of his peers.
Not at all. There are other remedies for the President, namely impeachment. In case you forgot, your team charged huim with insurrection. There was a trial. He was acquitted.
Remember what McConnell said after acquitting the Dirty Don.

"Indeed, Justice Story specifically reminded that while former officials were not eligible for impeachment or conviction, they were – and this is extremely important – "still liable to be tried and punished in the ordinary tribunals of justice."

Put anther way, in the language of today: President Trump is still liable for everything he did while he was in office, as an ordinary citizen, unless the statute of limitations has run, still liable for everything he did while in office, didn't get away with anything yet – yet.

We have a criminal justice system in this country. We have civil litigation. And former presidents are not immune from being held accountable by either one."

"I defended the president's right to bring any complaints to our legal system. The legal system spoke. The Electoral College spoke. As I stood up and said clearly at the time, the election was settled.

But that reality just opened a new chapter of even wilder and more unfounded claims.

The leader of the free world cannot spend weeks thundering that shadowy forces are stealing our country and then feign surprise when people believe him and do reckless things.

The unconscionable behavior did not end when the violence began.

Whatever our ex-president claims he thought might happen that day, whatever reaction he says he meant to produce, by that afternoon, he was watching the same live television as the rest of the world.

A mob was assaulting the Capitol in his name. These criminals were carrying his banners, hanging his flags, and screaming their loyalty to him.

It was obvious that only President Trump could end this.

But the president did not act swiftly. He did not do his job. He didn't take steps so federal law could be faithfully executed, and order restored.

Instead, according to public reports, he watched television happily as the chaos unfolded. He kept pressing his scheme to overturn the election!"

Charged with insurrection. A trial was held. He was acquitted, Your denial of this simple fact is a bit disturbing.

No numbnuts we have a legal definition of insurrection in law books. It's already defined. So what is it?
Attempting to overturn the valid certified EC votes of the states undermined the Constitutional order and is a Rebellion.

What Is Considered Rebellion?

Similar to insurrection, the term "rebellion" is not explicitly defined. Still, in legal contexts, rebellion is generally understood as an organized, armed, and often violent resistance or opposition to established government authority or its laws.

Rebellion typically connotates a more widespread and coordinated effort than insurrection, aiming to overthrow or undermine the existing governmental structure. To prove a violation of U.S.C. 2383, the prosecution must establish the following elements:

  • The defendant knowingly incited, engaged in, or gave aid and comfort to a rebellion or insurrection.
  • The rebellion or insurrection was against the authority of the United States or its laws.
  • The defendant's actions were willful and intentional.
Benedict Donald's actions surrounding Jan 6th qualifies him.

Impeached for the Jan 6th plot. Acquitted in the Senate and not removed from office, not criminal court or a civil court. Removal from office is all the Senate could do. Any criminal charges after the vote have to go through a court. Nothing in the Constitution that gives a Senate acquittal the ability to halt criminal prosecution for his actions. As the GOP Senate leader said at the time of the acquittal.

"...he didn't get away with anything yet – yet.

We have a criminal justice system in this country. We have civil litigation. And former presidents are not immune from being held accountable by either one."

C'ya in court Benedict.

Try the truth assholes.

There was no call to Pelosi where she could have rejected a request by the CiC to call out the NG on Jan 6th. You see the CiC has the authority to call out the NG, not Pelosi. Patel knows he is lying to the herd as usual. Benedict Donald did nothing but watch for about 3 hours after his MAGAMOB invaded the Capitol. He failed in his duty to protect the Constitution. He should be banned from holding office.

Patel has a letter that proves what he said. You people forget a president can make decisions and is protected by the Constitution while in office. The troops were offered and that alone negates his participation in any insurrection. Period.

More recycled lies.

"Minority Leader Kevin McCarthy posed a similar question on Fox News saying, “Was there a decision by the Speaker not to have the National Guard at the Capitol that day?”

The answer is no.

“On January 6th, the Speaker, a target of an assassination attempt that day, was no more in charge of Capitol security than Mitch McConnell was. This is a clear attempt to whitewash what happened on January 6th and divert blame,” Drew Hammill, a spokesperson for Pelosi told The Associated Press in an email.

The decision on whether to call National Guard troops to the Capitol is made by what is known as the Capitol Police Board, which is made up of the House Sergeant at Arms, the Senate Sergeant at Arms and the Architect of the Capitol. The board decided not to call the guard ahead of the insurrection but did eventually request assistance after the rioting had already begun, and the troops arrived several hours later."

Benedict Donald never ordered the NG when the MAGAMOB started to Riot on Jan 6th.

You seem confused Clarence. You think this is a criminal prosecution.

You are in court. And the Judges are asking your friends 'WTF are you loons even talking about?'

1. That's Trump's defense? The former president can be as lawless as he wants and is above the law and the writers of the amendment didn't mean him?? No wonder the trial moved forward with merit in Colorado.....where 6 Republicans are challenging him in court, (with the help of a Democratic group of legal eagles) Trump was the Chief Executive Officer of the United States, he's included.

2. People were charged with Sedition, Seditious Conspiracy for 1/6 and convicted of it, with near 20 year sentences....the penalties for sedition are even greater than a simple insurrection.... Trump, in the least, aided and abetted the enemy by sitting idle for 3 hours and not calling it off or sending in help, while Ashley Babbitt was killed...and others, and by telling 1/6 convicted felons, he would pardon them.....

The section of the 14th requires No Charges or convictions..... So we will see how the case turns out..... ???

This is where it seems to me, that more should be needed..... though by reading it plainly, no more is required?

Even if Trump lost, he could request full congress, to allow him to run, if 2/3s say yes, then he can.
I’m so old I remember when being an American citizen meant you were innocent until proven guilty by a court of law.

Dude, this is more than an accusation. We all watched this happen on live TV,

Actually, part of the problem is Trump watched it all on TV...but regardless, I don't think we should apply the 14th unless it legally falls under it's lettering...and TV does not.

I know what the pundits are telling you guys to think, but deep down, you all know what really happened.
I don't listen to pundits. I know what really happened. Traitor Trump tried to overturn the election...but that isn't a legal conclusion despite how obvious it is.

I do not give a fuck about Pelosi, the Seargent of Arms of both the House and the Senate denied the guard. Pelosi is one's boss and MCConnel the others. The commander of the Capitol police said that happened under oath.

You want to talk about the obvious you need to talk about the obvious fraud that bought those people to DC.

Of course you do. Why else would you defend this lie. "Kash Patel laid out how President Trump called for the National Guard on January 6 but was shot down by Pelosi, the heads of the Capitol Police Bureau, and the Mayor of Washington DC at the time."

Benedict Donald never called for the NG on Jan 6th, so it would be impossible for anyone to shoot it down.

Now you know.

They have proven that he did. Denying facts and truth is what cowards and traitors do. Guess what that makes you?
