It is assault and battery or attempted murder. What the perpretrator said or thought at the time does not matter.

If you are killed because someone hates liberals or to steal your money, is exactly the same crime. You are dead and the perp is a murderer.

yes, in some places it does. That does not make it right.

Why should a guy that kills you because he hates you get a stiffer sentence than a guy who kills you to steal your watch?

First and foremost, criminals don't consider criminal statutes or how severe they are before acting on a crime.

Second, life in prison is no different than life in prison plus 10 or whatever you choose to call it.

The outcome is the same. You're mugged or injured or dead.

It's good that you put this in the form of a question and not a declarative statement, i.e., "this is a hate crime".

We must always remember that The PC Police alone are in charge of determining what "hate" is, what a "hate crime" is, what "racism" is, and what words we are and are not allowed to say without having to fear their "consequences".

Yeah...and we already have laws that deal with more violent crimes moron...no need for "hate" to be a part of it...that requires mind reading.....the D.C. family...the husband was tied to a chair and beaten to death, the mother was tied to a chair and slashed and stabbed to death with a knife, the 10 year old son was tortured to make the parents comply and the house keeper was also killed.....to get 40,000 dollars.......was their hate involved......? And will the end sentence need "hate " to be an element to send these guys to prison for life, or better yet, the death penalty......

It was a hate crime. That white guy put his face in the way of black fists. The innocent blacks may have hurt themselves punching the white guy. Prosecute him when he gets out of the hospital.

since I don't know what the background of that case was, I couldn't tell you.

I'm sure there are aggrevating circumstances laws to meet out a harsher punishment for these guys.
