Obama was born in the US, and Cruz was not. Cruz is therefore not eligible for the Presidency. His election "victory" would be more fraudulent then Dubya's first term.

No, obama was born in Kenya, and his father was British which gave him dual citizenship at birth, so he too was/is/always will be ineligible to be president also.

So precedent has been set. obama opened the door for all future ineligible candidates.

He will be inundated with lawsuits against him because of his non-American birth, and Birther supporters of Cruz will only have themselves to blame for it when Cruz is denied office.


If his parents filed the appropriate paperwork with the State Dept. via the US Embassy then he can still be considered a natural-born US citizen.

Cruz is a natural born citizen and technically eligible to be president provided his parents were married and his mother lived in the US for the required period of time before his birth:

According to the law here in America, once you are born to an American citizen, you are a citizen right then and there. Technically, he could run for president. The Constitution makes no mention of Presidents who are dual citizens.

As Section 1 of Article 2 of the US Constitution plainly states:

No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States.

Add to that legal analysis by the Congressional Research Service of this clause, it is clear Cruz is still eligible to be President:

"The weight of legal and historical authority indicates that the term "natural born" citizen would mean a person who is entitled to U.S. citizenship "by birth" or "at birth", either by being born "in" the United States and under its jurisdiction, even those born to alien parents; by being born abroad to U.S. citizen-parents; or by being born in other situations meeting legal requirements for U.S. citizenship "at birth". Such term, however, would not include a person who was not a U.S. citizen by birth or at birth, and who was thus born an "alien" required to go through the legal process of "naturalization" to become a U.S. citizen."

The exceptions were merely for those alive during the signing of the Constitution.

Now if Cruz was born in Canada in 1789, he is eligible to run for POTUS..otherwise I don't think so.
