Actually, the Constitution is silent on the Supreme Court deciding cases on Constitutionality. The Supreme Court said it had that authority in Marbury v. Madison.
 
The constitution was written quite ambiguously so that it could be altered as time saw fit. Things would get way out of hand if the federal government let every state have its own healthcare laws. The ACA helps out thousands of Americans who can't afford their own healthcare and will ultimately make health expenses for those who can afford health insurance cheaper.

Hey stupid. That's why the constitution itself spells out how it can be amended. Times change and the constitution should change with them. But it has to be done thru the amending process.
