Saw a man draw a gun on an unarmed man who backed away

Saw a man lining up to finish the attack. As did law enforcement investigators.

He was shot square in the chest, not in the back running away.

That is just your opinion. More than likely what finished the attack was the black dude getting shot.

Know one knows nor will now ever know what the black aggressor would do next. He very well may --due to his proven violent nature(arrested before for assault) have been thinking about kicking the white dude in the head while he had him down on the ground. No one knows. The white guy said he was in fear of his life and with good reason. Thus he was not charged, and will not be charged as his actions were all lawful.

Meanwhile, the funeral for the black aggressor is being planned. Most should have learned from the trayvonista affair...apparantly many did not.

If the white guy had not defended his life with deadly force....his family could have been the ones preparing for a funeral.

Too bad your guy is dead. I doubt many care. Violent thugs disappearing from the face of this earth is applauded by all law abiding folks.
 
While the guy in this case, Michael Drejka, got knocked on his ass for accosting a woman but an unsettling amount of people thinks that justifies him killing the guy who knocked him down. Unless I'm reading the statute incorrectly Drejka's situation also was a simple battery.

There was no accosting - not even contact. If you watch the video he stays a full arm's length from her in the car at all times. He asked her if she an ADA permit and she went ballistic on him. Its why the cops pressed no charges or even made an arrest.

Not according to investigators....fleeing means back turned. Its why there was no arrest or charges.

The investigators did a thorough investigation. And you are correct.....no arrest, no charges. Case closed.

It would depend on the totality of all of the factors, but I can just about guarantee you that no one would feel that I had the right to shoot a "man" for the "simple" offense of touching me without my consent - the law says this is simple assault/battery meaning it doesn't rise to the level of the forcible felony required to use lethal force.
That is just it. Florida relies on your feelings at the time and totality of the circumstances if you reasonably fear harm or death.

Florida like most states has a law of self defense that says one must be in reasonable fear of your life to use deadly force. What 'reasonable' means is that it must be considered reasonable by the investigators or the courts if it goes to trial. Since in this case the investigation revealed that the shooter had a reasonable fear of his life there was no arrest and there will be no trial. case closed

Yeah so they can do what they want, lie and say 'I was in fear for my life" when most anyone else might have been pissed about being knocked down and may even want to fight but not be in actual fear for their life yet no one ever even looks at the case to see if what the shooter states matchs the evidence.

I will never forget watching Zimmerman being "coached" by the two detectives who were assigned to take his statement and investigate the shooting. They were telling him where the holes in his story were and how to fill them. There are known scientific tools you can use to analyze the probability of whether a person is telling the truth or not. In so many of these cases it seem likes the authorities don't care whether the suspect's story makes sense.

He was involved in the community...helped black kids and volunteered to protect his community. Before the incident he supported Obama and was a democrat. Bloom case....but when someone decides to steal something they should be aware the outcome may not be something they want.

I didn't cite Blooms case as an example of the stand your ground law, I cited it as an example of how stupid some of the people making life and death and personal freedom decisions for others are. Bloom is a federal judge and she doesn't understand the difference between advancing one's position and standing one's ground. She doesn't seem to have a very good grasp of the definition of self-defense either. You and 2A Guy are attempting to chastise me for pointing out some of the flaws in our system and wanting someone to do something about them. And while I know that most CCW holders are law abiding citizens, most doesn't mean all.

And as far as Zimmerman is concerned he is a depraved individual with a history of violence especially towards women. When he told an interviewer that even knowing now what they didn't know the night of the shooting - that Martin was 17 and unarmed and was where he had permission to be, that he still would have taken the exact same course of action and said it was God's plan that Martin died that night. She said Zimmerman then told her the phone was not hers and then "pushed" her.

She said she told him "not to touch me" and to give it back, and she said it then "became a pushing match." She said she got the cell phone from him and they continued pushing each other as she tried to push him out of the door of her home.

In the midst of this fight, she said her dog jumped up and marred his cheek by biting at it. She said the dog's response to his fighting with her "freaked me out" and she reiterated her demand that he leave.

She said she then ran up the stairs, and locked the door and called 9-1-1 on her phone. She said that as he walked out the door he yelled, "I can't believe you'd do this to me."

When the police came, she says they recommended she file for an injunction to protect herself from him the next day.

She did; on August 9, 2005, Zuazo requested a temporary restraining order.

It appears the media is failing to get much traction in their rather feeble effort to make this into another trayvon affair. Even though the shyster lawyer from the trayvon event is here trying his best to get some publicity. What a piece of crap that guy is. Last I heard he took most of the trayvon familys money and what he didnt take the old man blew at local casinoes. They had got a rather big sum from the apt. complex who paid up to quick thinking Z would be found guilty and they would be liable.

Not according to investigators....fleeing means back turned. Its why there was no arrest or charges.

Yeah so they can do what they want, lie and say 'I was in fear for my life" when most anyone else might have been pissed about being knocked down and may even want to fight but not be in actual fear for their life yet no one ever even looks at the case to see if what the shooter states matchs the evidence.

Let that one marinate for minute.

If you have ever been in a fight you know when your opponent is stepping back to line you up and when they are fleeing.

If you haven't been in such situation you really can not comment from any frame of experience - just feelings.

That is just your opinion. Know one knows nor will now ever know what the black aggressor would do next. He very well may --due to his proven violent nature(arrested before for assault) have been thinking about kicking the white dude in the head while he had him down on the ground. No one knows. The white guy said he was in fear of his life and with good reason. Thus he was not charged, and will not be charged as his actions were all lawful.

Meanwhile, the funeral for the black aggressor is being planned. Most should have learned from the trayvonista affair...apparantly many did not.

If the white guy had not defended his life with deadly force....his family could have been the ones preparing for a funeral.

Too bad your guy is dead. I doubt many care. Violent thugs disappearing from the face of this earth is applauded by all law abiding folks.

What is on the tape is open to interpetation....especially the part where he took a step backward no doubt in regards to suddenly seeing a pistol in his face. Unfortunately for him the white guy most likely did not see that small backwards step which is irrelevant anyhow ....as in one can take a backward step and then lunge forward. What the black dude should have done was raise his hands and say please, please do not shoot. Either that or took off running. Taking a backward step was of no help to him at all. Also...being unarmed is irrelevant...many peeps have been beaten or stomped to death. You simply have a huge lack of knowledge of the law and how it is applied.
 
This wouldn't be happening if Pam Bondi filed charges.

Personally, I don't think that was a righteous shooting.

Why not? Granted it was a short clip of an incident, but I saw an assault by the party that was later shot. I also saw a second party approach him just before the shot. That was about as self defense as it gets.

Can you explain how and why it wasn't until the year 2017 that the first white person was executed in the state of Florida for the murder of a black person? How is that possible when hundreds of black people where lynched there?

I agree absolutely. The guy whose life was in danger had to make the decision. It is easy to second guess these cases with a 20/20 hindsight. But in order to properly understand this event you have to place yourself in the position of the white dude. He had to make a decision very,very quickly or perhaps have his life taken from him or suffer grievious bodily harm. You can tell by looking at him he is not agile, it even appears he might be handicapped by his awkward stance and the difficulty he has getting up off the ground...certainly not very capable of defending himself...he is fortunate he had a 'equalizer' in his pocket.

Under what circumstances an aggressor can claim self defense is first year criminal law stuff.

Well, no doubt the primary factor for lynching was that blacks committed so many horrendous crimes especially rapes. Say what you will about vigilante justice: the crime rate was much lower in those days and one could walk down any street in America day or night without fear.
 
Letting the shooter off the hook without even a full investigation or possible charges of manslaughter being brought, is what challenges our laws that are used inappropriately to justify such a thing.

He must not think so when going around starting crap, and especially with someone's girlfriend while her kids was in the car... I know, I know, but whose dead and whose still alive right, and in that lay the justification for it huh ?? Don't try to defend the indefensible, because if I were a bettin man, I'd be willing to lay money down on the fact that most in the country can see the wrong in this situation.

Remember it was a push, but the guy didn't advance him any further, otherwise to take advantage of the cat in his vulnerable state while on the ground. But the one on the ground had time to slowly collect himself draw his weapon, and then took the shot as the victim was in retreat when saw that weapon.
