He and his brother murdered three people in Boston, MA.

One of em is dead and the other was arrested.

He will be treated like any other suspect.

Innocent till proven guilty.

Of course they have loades of evidence so I think his guilt is a forgone conclusion. Hope he gets the death penalty and I'm glad the other dirtbag is dead.

That distinction is an abomination all people that are really interested in liberty and freed should find abhorrent.

What I find an abomination is giving a "combatant" due process thereby not getting intelligence information from him that could possibly stop further terrorist attacks.

This isn't about a conviction, it's about stopping further attaks.

I'm sure Timothy McVeigh was also given his Miranda Rights after he killed 168 innocent people.
You can bet that Dzhokhar Tsarnaev's story will end like McVeigh, he'll be easily found guilty and he will be put to death.

His citizenship was obtained under false pretenses.

He came here not to be a citizen, but to mass murder American citizens with a devastating bomb. Early examinations said the bombs didn't ignite properly and killed fewer people than planned.

It’s not news that The Daily Show is criticizing Fox News, but this week one segment took a distinctly constitutional turn.

In the segment, titled “Weak Constitution,” Stewart criticizes Fox News analysts for some of their reactions to the handling of Boston bombing suspect Dzhokhar Tsarnaev.

Many were upset about the idea of Tsarnaev being read his Miranda rights (a Fifth Amendment issue Constitution Daily explored here and here), and some, including Sean Hannity and Ann Coulter, wanted him to be treated as an enemy combatant instead of in a civil court (which would concern the Sixth Amendment, which guarantees the right to a fair, speedy trial). Fox contributors Eric Bolling and Brian Kilmeade also suggested wiretapping Muslim mosques.

Stewart poked fun at Fox News for “jettison[ing] constitutional amendments like Han Solo dumping his cargo at the first sign of an Imperial cruiser.” Except, of course, when it comes to the Second Amendment, of which Hannity said, “No ambiguity here.”

What do you think of Stewart’s criticism? Whatever your view, the segment offers an entertaining reflection on how we turn to the Constitution for answers to today’s toughest questions–but we often disagree on which side it supports.
 
It's not about a conviction.

It's about getting intelligence. He is a combatant. He shouldn't have miranda rights (the right to remain silent)
The Miranda Warning has nothing to do with his right to remain silent. Miranda simple warns the accused that what they say can be used against them in court. With or without the warning the accused has the right to remain silent.

Integrators were allowed to interrogate without the Miranda Warning to gain information about public safety. There was never a plan not to give him the Miranda Warning just delay it. The public safety exception would be meaningless if interrogations are given an open-ended time horizon.

There is plenty of evidence to convict. Refusing to give the Miranda Warning would give the defense cause for objection because of the limitation of the exception. Why take chances on a conviction when Feds had plenty of time to interrogate the prisoner about public safety issues?

He was 8 years old when he came to the US. Chances are he didn't even make that decision.

I am not sure what he was told but it didn't matter if he were mirandized or not. All it meant was that he could be questioned without a lawyer and what he said could be used in court. Just because a person is mirandized does not mean they are forced to talk.

If it didn't matter, then why did he stop talking after being mirandized?
 
They don't need the pre miranda confession to convict his ass, they have plenty of other evidence. They needed to talk to him to determine if he was part of a cell, or just a lone wolf type.

Once they figured these guys acted alone, the mirandized him, and now anything he says will be used against him at the criminal trial.
