Actually, all judges are legally capable of doing civil marriage ceremonies, and many do. But you seem to think that Supreme Court Justices generally don't do that....based on what?Supreme Court Justices generally do not officiate at weddings. That is not their job. The fact that she went out of her way to do so indicates a lack of impartiality. It doesnt help that she's also gay.
No, she will need to recuse.
LOL.....always good to hear from other wingnuts besides Silhouette.
To be clear, you are defining "wingnuts" as people who believe their US Supreme Court Justices should give a public appearance of lack of bias..
..this cult and its sychophant's overweening will pass the tipping point into tyranny upon the moment these two Justices appear on the gay marriage case in a couple of week's time.
Nazis in Germany around late 1930s also incrementally passed this tipping point.
Foolishness is not a quality of a US Supreme Court Justice. It was/is a public flaunting of lack of wisdom (I would actually call it calculated-arrogance), their presiding over gay marriages while the question hangs in the air.

This is behavior unbecoming on an unsettled question of law for a US Supreme Court Justice. I just stumbled upon this today:
WASHINGTON (AP) — Justice Elena Kagan has officiated for the first time at a same-sex wedding, a Maryland ceremony for her former law clerk and his husband.
Kagan presided on Sunday over the wedding of former clerk Mitchell Reich and Patrick Pearsall in the Washington suburb of Chevy Chase, Maryland. That you think this is 'breaking news' just shows how far down the rabbit hole you have gone.
Are or are not the two stories' colliding occuring in just a few weeks? Kagan and Ginsburg presiding over gay weddings and the case-to-be-heard on same-sex marriage? Yes or no?
2013 Justice Ruth Bader Ginsburg presided at a same-sex wedding Saturday evening at the Kennedy Center for the Performing Arts.
The wedding was between Kennedy Center President Michael Kaiser, who is a longtime friend of hers, and John Roberts, a government economist... “It’s very meaningful mostly to have a friend officiate, and then for someone of her stature, it’s a very big honor,” Kaiser said... She is? I was not aware you were privy to her sexual orientation.Apparently late 2014 so yeah she was in office.I see. I was not aware that she officiated it after she was a Supreme Court Justice. The answer to the first quesiton is no. Not if her response was "Officiating would indicate bias on my part so I cant do it."So then let me ask you this...If she had refused to officiate over that wedding....wouldn't that, too, show bias? How does one adhering to the law by officiating over a gay wedding show bias?
Easy. When one is a US Supreme Court Justice who Upheld in 2009 that no judge may sit on a case yet to be Heard for which s/he has displayed clear bias. This rule applies most rigorously to a US Supreme Court Justice.
So that being said.....being asked to officiate it....regardless of her answer.....would put her in a position to show bias one way or the other.....am I correct?
To be frank...it was poor judgment on her part.
She's a dyke. Of course she's for gay marriage. She couldnt in a 100 years be unbiased about this. Thats why she needs to recuse herself.
No, the equivalent of this would be a Justice in a photo pumping gas that came from oil while a challenge of law was pending to be heard in SCOTUS on the Keystone Pipeline.Justice Ruth Bader Ginsburg presided at a same-sex wedding Saturday evening at the Kennedy Center for the Performing Arts.

“I think that everything that’s going on that makes same-sex marriage possible and visible helps to encourage others and to make the issue seem less of an issue, to make it just more part of life.”

Seeing the writing on the wall is precisely the reason these two Justices must recuse themselves. The anti-gay marriage folks see the writing on the wall so isn't that shocking to see these hysterical excuses are already starting to tickle in.

I will be disappointed if this all completely plays out before the Presidential campaign season. The anti-gay marriage folks see the writing on the wall so isn't that shocking to see these hysterical excuses are already starting to tickle in.
Oh, Sil knows what's coming. And we're going to be witness to a spectacular meltdown with a 3 month opening act. All the babble about 'tyranny' and 'nazis' is just him warming up.
