I actually agree that he didn't incite the attack. The proud boys and the other groups were planning it we'll before the rally. Now, if there was evidence that Trump was aware of those plans, then that would make him guilty of conspiracy.

However Trump did actively take part in a conspiracy to illegally subvert the election with his plan to submit a slate of phony electors and have Pence refuse to accept the real electors' votes. There is plenty of evidence that Trump was not only aware of this plan but was a driving force behind it, despite attempts to claim that it was done without his knowledge.
