So how is it that you Trump Humpers want Biden held accountable for classified documents, but not Trump. Shouldn't they both be held equally accountable, it makes you sound like a political hypocrite.


Trump was POTUS and could declassify any document at any time while he was POTUS and did just that. Also, existing EOs from GW Bush and Øbama automatically declassified documents when POTUS took them out of the White House. Which happened when Trump took them while still POTUS. As VPOTUS, Biden had no such authority and is covered by the FRA.

You will note that Trump, as with Øbama, is covered under the PRA. Thus when they discovered Øbama had classified documents in 2018 no big deal was made and the Obama Foundation paid the Archive to remove the documents to proper storage. They negotiated that as the PRA anticipates.



And now they discover classified documents that Biden had from when he was a Senator.

"His authority to classify and control access to information bearing on national security ... flows primarily from this constitutional investment of power in the President, and exists quite apart from any explicit congressional grant."

So where is any of that in the Constitution? The Constitution just says the President has the sole ability to classify and declassify documents according to the court, not any process described by the leftists in your article.

However, delegations of authority to classify information originally that were made in accordance with the provisions of section 1.4 of Executive Order 12958 of April 17, 1995, as amended, by officials designated under this order shall continue in effect, provided that the authority of such officials is delegable under this order.

This order shall be published in the Federal Register.
