This is in regards to a 2009 leak probe by the Justice Department into the alleged criminal activity of Fox News justice correspondent James Rosen, after he published stories about North Korea. I surmise that Obama has a very low view of the information gathering methods some reporters use. Freedom of the press? Yeah, you can kiss that goodbye.

Court documents show abundant evidence gathered from Kim’s office computer and phone records, but investigators said they needed to go a step further to build their case, seizing two days’ worth of Rosen’s personal e-mails — and all of his e-mail exchanges with Kim.

Privacy protections limit searching or seizing a reporter’s work, but not when there is evidence that the journalist broke the law against unauthorized leaks. A federal judge signed off on the search warrant — agreeing that there was probable cause that Rosen was a co-conspirator.

Hmmm

So when will the investigations of Dana Milbank begin?

Very soon I'd imagine. The pieces keep falling into place though, Liberals can run from these scandals, claim they are "falling apart"; but in all reality the storm is fast approaching.

Obama's been shielded by the media since he first was elected to the Senate.

His backbone was made up of journalists and unions.

Unions are now seeing the harm he has done them and the press realizes the danger he presents, not only to OUR freedoms, but to THEIRS! :eusa_whistle:

That aside, the most alarming detail is the implication for Rosen. Another tool the FBI wants to use to make an example in this case is a federal indictment of the journalist.

[FBI agent Reginald] Reyes wrote that there was evidence Rosen had broken the law, “at the very least, either as an aider, abettor and/or co-conspirator.” That fact distinguishes his case from the probe of the AP, in which the news organization is not the likely target.
Using italics for emphasis, Reyes explained how Rosen allegedly used a “covert communications plan” and quoted from an email exchange between Rosen and Kim that seems to describe a secret system for passing along information.

The United States government wants to charge a reporter for reporting on classified information. By agreeing to authorize a search warrant in the case, the Post reports, the judge overseeing the case agreed with the FBI that Rosen might be a conspirator. Whether or not someone in Kim's position should receive whistleblower protection for revealing a state secret is one debate. Whether or not the person that hears the whistle should be charged is another issue altogether.

Linking the Kim case to Julian Assange, similarly investigated for sharing information leaked to him, The Guardian's Glenn Greenwald writes:

Under US law, it is not illegal to publish classified information. That fact, along with the First Amendment's guarantee of press freedoms, is what has prevented the US government from ever prosecuting journalists for reporting on what the US government does in secret. This newfound theory of the Obama DOJ - that a journalist can be guilty of crimes for "soliciting" the disclosure of classified information - is a means for circumventing those safeguards and criminalizing the act of investigative journalism itself.Over the weekend, the CEO of the Associated Press, Gary Pruitt, was interviewed on CBS' Face the Nation. Pruitt indicated that Justice's recently revealed investigation into a 2012 leak is causing existing sources to balk.

Fox News Reporter James Rosen May Face Criminal Charges for Reporting on the CIA

chiilling, to say the least. And here Obama wants a law to shield himself, which of course would shield his cronies as well.

So, should Rosen have charges brought against him? If so, then we need to start an investigation into every leak that has occurred and charge all those reporters as well.

Journalism rarely exists, today the 'News' is all about ratings. "BREAKING NEWS", lol. Attention getting? Not anymore. Remember when the news came in paper and an EXTRA was a rare and generally major event?

cable with 24/7 news channels changed all that. We can blame Ted Turner.

I dunno. The news cycle dominates. Sure Fox's motive was less about reporting than finding something critical of obama. I'd like to know Kim's motives. Did he thing Obama wasn't pushing sanctions enough, and tried to force Obama's hand?"

This is quite different from Libby maniupulating Judith Miller to push a false story. It's also a lot different from a guy like John Dean acting on conscience. Kim may not be a bad guy, but when you work for the govt you don't leak state security stuff without some really compelling reason.

And you don't think the left has done the same to the right?

Now it seems that this administration didn't stop with the AP. Now it's been expanded to cover some of Fox News reporters.

However, it remains an open question whether it’s ever illegal, given the First Amendment’s protection of press freedom, for a reporter to solicit information. No reporter, including Rosen, has been prosecuted for doing so.

Apparently, Rosen had done nothing wrong as no charges or indictments were handed down. Business as usual for the Chicago style administration.
Holder is a piece of work with very dirty hands.

The part that stands out to me: "They obtained a search warrant." -- Meaning a judge thought there was enough probable cause -- meaning the law was followed, the 4th amendment has not been violated -- what's the big deal?

The reporter isn't being charged with anything -- they'll try to scare him into cooperating witch is perfectly legal but a good lawyer will tell him not to worry. He didn't pay for the info, it was given to him.

The DOJ finding a judge to obtain a search warrant? I'm sure he has a 100 of them in his back pocket for his disposal. Seems more like just showing how heavy handed Holder can be when it comes to the 1st Amendment. Nice try though, Hazel.

That Department of Justice is way out of control! There's another story that just broke a few minutes ago--the DOJ Also targeted Fast and Furious Whistleblower!

Holder must think he's God!

So does that mean any time the DOJ obtains a warrant and executes a search they are breaking the Constitution?
