Simple is the reality is we have what is called due process and innocent until proven guilty.

I could say I believe you are a terrorist or your name could be the same as a Irish IRA member and by your way of thinking I have the right to deny you your Constitutional Rights based on a list or someone opinion of you.

Until you have full proof the person is a terrorist and their motive is to kill innocent people then no you do not have the right to infringe on someone Constitutional Rights.
