That's all bull. We have judges to judge a subject on more things than just the crime. I've been to a court case and seen this first hand.

The judges meets with the arresting officers and possibly the jailer before the case is even heard. What he or she wants to know is the conduct of the suspect. They want to know if they fought with police, if they were cooperative, if they lied and what they lied about, how the suspect cooperated with the jailer, how he conducted himself after being locked up and so forth.

The judge also goes by the criminal history of the suspect, and how they behave in court. All these things and more weigh in on how the judge is going to judge.

If a white guy and a black guy are busted with coke, the same amount, in the same area, they may be treated differently by the judge, but not because of race, but how they acted throughout the entire episode. If the white guy dresses appropriately for court, shows ultimate respect, the judge will take that into consideration. The black guy who wants to dress up like a bad ass, shaking his head back and forth throughout the proceedings, rolling his eyes, acting if he doesn't care, the judge will take that conduct into consideration as well.

If it were as simple as giving the same sentence to everybody for the exact same crime, then we wouldn't need judges. All we would need is a computer to type in the charge, and spit out the sentence.

If the white female gets probation, and the black male gets a year or two in jail, it's likely not a gender or race issue. If the white female is a first time offender, shows remorse in the court room, apologizes to the court for her actions, then it doesn't make sense for a judge to toss her in prison and chancing he will make a career criminal out of her. The black thug looking male likely has a criminal history, and didn't seem to learn his lesson the first few times. That's why he gets sent to prison.
