If Justice Kennedy Had Known A Christian Would Be Jailed Less Than 3 Months Later...

Kennedy would've voted "no" on federal gay marriage if he had a crystal ball & saw Davis in jail.

It was not her Christianity that landed her in jail.

It was her 1st amendment right to exercise her Christianity that landed her in jail.

No it was her refusal to do her job that did that. There is nothing in the 1st that gives her the right to defy a Court order to do the job she was elected to do. Your right to practice your religion stops when it starts to infringe on other citizens rights

Where in the Constitution does it say government has the right to make marriage licenses?

Read the 10th amendment. As its the States issuing such licenses.

States yes Feds no.
Supreme Court ruling just over ruled the States rights.

federal law is always superior to state law...

now go learn something about the constitution before you whine.

I have nothing against same sex marriage. But I do have concern that proponents of SSM believe it legalizes sodomy and homosexual acts. As far as I know, those are still criminal offenses. Can any one cite the law that legalizes that behavior?
On a sidenote, does anyone know what you get when you cross a rooster with a telephone pole?

A telerooster alarm clock?

You should read the list of duties for the Feds in the Constitution.

No no no...jillian, you got it all wrong.

Federal law is only superior to state law when it's forcing gay marriage on the states. (DOMA 2013 said the exact opposite of that on the question of who decides marriage in rendering its Order actually, but why digress?) If it's protecting Christians from going to jail for passive refusal to accomodate a gay wedding based on strong faith values, then the federal law is INFERIOR to local public accomodation laws..

Make sure you get that right: our legal system is now subjective depending on which cult has created the strongest atmosphere of fear. See my signature for a visual representation of where this is heading if we don't rein this little pony in and fast...

Lawrence v. Texas struck down those laws back in 2003 and for good reason.

A cock ring? lol

It was the Supreme Courts decision that she openly violated

Of course, Kennedy would support contempt charges

That's not what the OP asked. It asked if Kennedy knew ahead of time where this was going with Christians in less than 3 months, would he have voted the way he did in June?

There, I made it bigger so you wouldn't "forget" next time.

Supreme Court ruling just over ruled the States rights.

Now read the 14th amendment. Specifically the part about due process and equal protection.

Under laws yes.
Not marriage.

Marriage law is still law.

They were not equal under the laws.

Nope. They weren't. Which was the point of the USSC's intervention.

The laws should have changed to help them become equal under the laws, not the Supreme Court that forced States to marry them.

Why would same sex couples have to wait for a vote from a state legislature before they can get equal protection under the law? The States aren't allowed to do that to start with.

So you didn't ask this?

So, if Kennedy had a crystal ball and saw Kim Davis sitting in jail less than 3 months after he released the June Opinion, would he have voted differently?

Your question has been asked and answered. As we all knew you would, you ignored every reply in favor of the diet of pseudo-legal pablum you feed yourself.

And?

No, check out Kennedy's vote on Employment Division v. Smith for the answer to your question.

Federal legislature are the ones who should have changed the inheritance laws or other ones that excluded them.

No, the question was about Kennedy, not Kim Davis. Try again.
Then why did you bring up Kim Davis here?

So, if Kennedy had a crystal ball and saw Kim Davis sitting in jail less than 3 months after he released the June Opinion, would he have voted differently?

Your question has been answered. You just ignore the answer and then ignoring it pretend it doesn't exist.

You know, like you do with everything you don't agree with. So how's that working out for you?

It won't matter. This is just another Silo thumb sucking thread. It exists as an act of self soothing. Your participation is incidental.

Federal Legislation didn't. Thus rights were being denied same sex couples by the state. See the 14th for why that doesn't work.

It was her 1st amendment right to exercise her Christianity that landed her in jail.

Actually, its the 1st amendment that forbid her from doing what she did. As a government official weilding state power she attempted to use that power to force people to obey her religion.

That's the State establishment of religion. And forbidden by the 1st amendment. Which is one of the myriad of reasons Kim Davis lost. And same sex couples can get marriage licenses in Rowan county with relative ease.

It was Government that made law against the right for her to practice her Christianity.

And rightfully so. Made up religious beliefs are not a ticket to put yourself above the law.

Made up?
The bible is very clear on it.
