THE DIFFERENCE IS THIS: Obama used Executive Orders to countermand actual laws and parts of the Constitution. This Executive Order (assuming it ever comes to being) would merely reflect a completely-defensible re-interpretation of SIX WORDS in the 14th Amendment.

There is no law or binding Supreme Court decision supporting the interpretation that currently guides the Federal Government on this point. There is one bit of dicta, found in a footnote of a Supreme Court opinion. That's it.

The Executive Order would be appropriate and within Trump's authority as President. In fact, he would be doing us all a service by raising the point for final adjudication.

Because it would be challengeable in court. As soon as any "anchor baby" is discriminated against by a Government agency, acting in accordance with Trump's guidance, the ACLU will jump on the case, file suit for Declaratory Judgment, and the case will inevitably rise to the USSC. If Trump is wrong, he will be beat down. Otherwise, "we" win.

Or maybe Congress will take the initiative and clarify the point, once and for all. But I'm not holding my breath for that to happen, particularly if the D's win on Tuesday.

Notice it was heard 16 years after the 14th was ratified and shoots the shit out of anyone born on US soil is an automatic citizen

There are several points to be made on this debate.

1. The 14th Amendment was passed to give recently freed slaves political rights. Declaring them citizens if born in the US. Taken in the narrow sense, it would not apply in present day.

2. United States v. Wong Kim Ark (1898) was based on the 14th, but this was to legal immigrants.

3. In fact, all cases involving the 14th center on citizens of the US, none of whom were illegals.

4. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. Note citizenship is conditional to being subject to the jurisdiction of the US. Illegally born may be denied on that basis perhaps.

One thing is clear, the Supreme Court has not directly answered the question. An executive order, no matter how poorly considered, would open the door to a ruling. Frankly, I hate executive orders.
