Judge Merchan's Letter to Trump Trial Lawyers Raises Eyebrows

It seems to be so serious that judge is moving towards probation. The entire case has been compromised.

"Prosecutors have not yet indicated whether they plan to request prison time. Merchan said on Friday that Trump lawyer Todd Blanche could accompany his client to a mandatory meeting with probation officials for a pre-sentence interview."

This is all so hilarious people are speechless; even Trump's lawyers.
 
He’s wrong. The judge can, here, declare a mistrial since there has yet to be any entry of judgment (because it hasn’t gone to sentence yet).
Just to clarify what I wrote earlier:

A judge can declare a mistrial after verdict regardless of the timing if juror misconduct establishes a legal need for it.

NY CPLR Section 4404(a):

(a) Motion after trial where jury required.  After a trial of a cause of action or issue triable of right by a jury, upon the motion of any party or on its own initiative, the court may set aside a verdict or any judgment entered thereon and direct that judgment be entered in favor of a party entitled to judgment as a matter of law or it may order a new trial of a cause of action or separable issue where the verdict is contrary to the weight of the evidence, in the interest of justice or where the jury cannot agree after being kept together for as long as is deemed reasonable by the court.

(The CPLR is civil practice law and rules but is applicable to criminal cases’ motion practice.)
 
Trial's over. Verdict rendered. He can appeal (after sentencing). If the appeals court wants to vacate the verdict...they can.
But until then, the wheels of justice grind on...:)

Trial judge would declare a mistrial, it wouldn’t have to go to appeals court…but Merchan isn’t a real judge
 
Sounds like a set up. Liberals got their 'conviction' and it didn't work out for them. Enter a mistrial, they will still call Trump a felon and reschedule a new trial weeks before the election. All the other clown show trials are are on hold until after the election.

If true, it should lead to a mistrial. Merchan took it seriously enough to give a heads-up to both sides.

Questions have surfaced regarding the jury in former President Donald Trump's New York City hush money trial after the presiding judge flagged a post to social media alleging that a juror had spoken about Trump's verdict before it was handed down.
According to New York State Supreme Court Justice Juan Merchan's letter, which was sent to Trump lawyer Todd Blanche and Manhattan District Attorney Prosecutor Joshua Steinglass, a comment was left on the New York State Unified Court System's Facebook page by a user under the name "Michael Anderson," who wrote, "My cousin is a juror and says Tump is getting convicted. Thank you folks for all your hard work!!!!"
The comment was in response to a post by the court on May 29, a day before the former president was convicted of 34 felony counts in connection to hush money paid to adult-film actress Stormy Daniels during Trump's 2016 presidential campaign. Merchan wrote that as of Friday, Anderson's comment was "labeled as one week old."
It is unclear if Anderson is related to one of the 12 jurors who served on Trump's case, or if the comment was posted online prior to the former president's conviction on May 30. Several Trump supporters suggested on social media that the comment was grounds for a mistrial.

Doesn't matter. A mistrial is declared while the trial is still in process. And the judge sends the jury home.
The trial is over. Conviction handed down. Sentencing 7/11. Appeals process to be followed now.
Maybe get an accelerated appeal. But this doesn't look like anything that would affect trial.
Some asshole makes a post and you and the faithful swallow it hook, line, and sinker? :)
