They argued an original 302 was destroyed. The court responded at that time by putting off his sentencing and providing Flynn additional time to present the exculpatory evidence of which he claimed entrapped him, which included what he claimed were “material alterations to the 302s." His lawyers came back with that evidence. Judge Sullivan rejected Flynn's arguments but offered Flynn the opportunity to withdraw his guilty plea, if that's what he wanted, but then would mean defending himself in court. Flynn rejected that offer and maintained his guilty plea. That was in December, 2018. A year later, December, 2019, the court rendered the opinion I posted that any edits to the FD-302 were not material.

Flynn lied. He admitted it and he's been convicted for lying. Deal with it.

Then about 6 months ago, the court rendered the opinion I posted, declaring there was no entrapment and specifically stated the 302 was not materially changed.

Flynn already argued this. Sullivan discusses the Flynn's arguments of a 302 being edited in his opinion. He addressed the claim there was an original 302 that was destroyed.
