Clearly, very clearly...the prosecution was openly mocking the Defense. Rightfully so, what bonehead came up with that defense? The optics alone..good grief, it's a misdemeaner possession charge. The lawyers should have advised Kyle to eat the charge...it means nothing.
Now it's a meme. Being a celebrity defendant is very dangerous..most go to jail, if you haven't noticed~

It was never a defense to the crime. The prosecutor, probably woke, thought he would make some woke points with the media. The defense is doing what defense does, strike out lower charges so they don't have to be litigated.
