B. Those tapes were not under subpoena at that time

B) We're not talking about tapes when it comes to the FBI demanding they shut everything off. We're talking about them trying to prevent discovery by the Defense should it come up.

Bullshit. They only found just over 100 documents that would fall under the NARA. Barely enough to full a single folder.
The rest are personal records and forms that belonged to Trump.

You need to learn the difference between presidential records that needed to be archived and records that were of a personal nature that belong to every employee of the US Government, much less a president.

Wrong....THEY TOOK A NUMBER OF BOXES......not all of them were subject to archiving.
What Trump wanted to do was stop the DOJ from monkeying with his own personal property. He wanted someone who was independent to go thru everything and document it before the FBI started planting evidence.
Even Trump didn't know what all he had. The FBI tried to take advantage of this fact.
They had to return some of the boxes because they had no right to take them in the first place.

It was Trumps responsibility to separate presidential from personal records before he left office. The second Trump left office, everything not in the personal records/property pile, goes to the National Archives, where Trump could later request (himself or his designee) to sort through them.

When that "clerical error" is in violation of half a dozen federal laws.

They searched Mike Pences house because of "clerical errors". They searched Joe Bidens house because of "clerical errors".
