Her usage was widely known to the over 100 State Department and U.S. government colleagues she emailed, consistent with the practice of prior Secretaries of State and permitted at the time.


Was it allowed? Yes. The laws, regulations, and State Department policy in place during her tenure permitted her to use a non-government email for work.

The 2009 National Archives regulation in place during her tenure required that "[a]gencies that allow employees to send and receive official electronic mail messages using a system not operated by the agency must ensure that Federal records sent or received on such systems are preserved in the appropriate agency recordkeeping system." The regulation recognizes the use of non-government email accounts.

As she has stated, Clinton's practice was to email government officials on their ".gov" accounts, so her work emails were immediately captured and preserved. In fact, more than 90% of those emails should have already been captured in the State Department’s email system before she provided them with paper copies.

A Politifact analysis also confirmed that Clinton's practices complied with laws and regulations, including support from the former director of a prominent government accountability organization: "In Clinton's defense, we should note that it was only after Clinton left the State Department, that the National Archives issued a recommendation that government employees should avoid conducting official business on personal emails (though they noted there might be extenuating circumstances such as an emergency that require it). Additionally, in 2014, President Barack Obama signed changes to the Federal Records Act that explicitly said federal officials can only use personal email addresses if they also copy or send the emails to their official account. Because these rules weren't in effect when Clinton was in office, 'she was in compliance with the laws and regulations at the time,' said Gary Bass, founder and former director of OMB Watch, a government accountability organization."

On March 6, 1999, The New York Times reported that Government investigators believed China had accelerated its nuclear weapons program with the aid of stolen American secrets. The article said the Federal Bureau of Investigation had focused its suspicions on a Chinese-American scientist at the Los Alamos National Laboratory. Two days later, the government announced that it had fired a Los Alamos scientist for ''serious security violations.'' Officials identified the man as Wen Ho Lee.

Dr. Lee was indicted nine months later on charges that he had transferred huge amounts of restricted information to an easily accessible computer. Justice Department prosecutors persuaded a judge to hold him in solitary confinement without bail, saying his release would pose a grave threat to the nuclear balance.

Following another week of damaging stories about her email practices, Hillary Clinton came to Iowa with one message for the Republicans investigating her: Get lost.

During Iowa’s famous Wing Ding dinner in Clear Lake, the 2016 Democratic front-runner dismissed Republican concerns about the transparency of her email arrangement as secretary of state, and said she’s already been exonerated by earlier investigations into the 2012 Benghazi attacks.

“Benghazi was a tragedy where four Americans died… but let’s be clear: Seven exhaustive investigations… have already debunked all of the conspiracy theories,” she said. “It’s not about email servers either. It’s about politics.”

Clinton even opened her speech with a taunt aimed at GOP theories that she intentionally deleted emails to hide something: “You may have seen I recently launched a Snapchat account. I love it: Those messages disappear all by themselves.”

The crowd exploded in applause, and many Iowan Democrats told POLITICO they agree with her.

“I think it’s the other side trying to throw whatever at the wall and seeing what will stick, and then the news organizations having to have something to talk about all the time,” said Iowan Paul Stough, holding a plate of chicken wings and pulled pork at the famous concert hall Friday night. “I think mostly it’s: she’s the front-runner and the press in general likes to knock the front-runner down.”

Stat, Clinton's handlers are doing the best they can. But it is not going to work. I'm not say she's going to be held responsible for what she's done because afterall, she IS a Clinton and there are different rules for her than the rest of the world.

But in your heart of hearts, you know she's fouled up big time. Erasing 30,000 emails and she's telling us they were all incidental, Chelsea's wedding and yoga lessons. Thirty thousand??? Come on. Like a poster just said, Nixon got in deep shit when erased 8 minutes of a taped conversation.

The fact she refused to give up the server for 5 months stalled the government so she could get the computer professionally cleaned. Why they didn't go in and take it in March is beyond me. No, actually it's not. She's Hillary.

You make fun of Benghazi. Odds are there were many emails about Benghazi on that hard drive. Foreign country donation to the money laundering, "Clinton Foundation,' too. Not to mention Top Secret documents she refused to handle in the proper manner or so, I have to say it, she is so stupid she couldn't identify a sensitive document when she saw one. But what was she going to do with those TS documents? She couldn't have them archived because she hadn't been using the government server. She just screwed up. Royally.

Do I think she should go to jail? Yes, but we both know that won't happen. With the precarious position she put this country in due to hackers getting TS documents and information on improper donations, she could be blackmailed while SOS,

This is where we need the Donald. He could negotiate with Russia and China to get those emails back. They are most likely archiving them properly and no one , including us, can get at them. They operate better than the intellectually challenged Hillary. Lord help us, don't let her be president!
