She was with a foster family. Now she is with a foster family of her own tribe. It is a federal law. Not something the police dreamed up.

Anyone who knows anything about kids knows that stability is the most important thing that they need (in addition to food, shelter, etc...). It may be that the law compels this. Or it may be that it does not compel this and that it is the consequence of some fucked up bureaucrat. Either way, it is not right and it is probably emotionally harmful to the child.
 
It's a shame when kids pay for poorly administered laws. If the Choctaw nation considers 1/64 Native blood sufficient to be a tribal member, she should have been placed with a Native family when she first came into care. At least, the local tribe should have been consulted and if they gave it a pass, CPS could proceed with a non-native placement. Now that states are tightening up on regulations that child welfare has been ignoring, little kids like Lexi are paying the price.
Most people don't realize that during much of the 1900's, kids were taken from their Native families by force and educated as "white," in the hopes it would help them achieve more in their lives. But the Native culture was further decimated by it. So it had to stop. Native tribes have a right to intervene in any child custody proceeding. They need to stay apprised of all Native children in the foster care system and have a right to intervene whenever they feel it is in the child's best interest. For kids like Lexi who had one parent with a small percentage of Choctaw blood who was not participating in tribal culture, a lot of child welfare agencies ignored these laws.

This was a foster family by its very nature temporary. Foster children are routinely removed from one family and placed with another.

In 1978 the tribes finally forced the federal government to stop stealing children from their tribes and passed the Indian Child Welfare Act. Lexi belongs with her people.
 
More liberal racism. Hey, why is breaking up illegal alien families so bad if the liberals are OK with the government doing it for racist reasons? This little girl started living with the Foster family at the age of 2 and is now 6, hell she cant remember any other home, so how cruel is this and how racist? How does having less than 2% DNA for an Amerindian tribe trump all her other white DNA?

But this is what you get in a racist legal system that deliberately ignores white rights in favor of any and every minority group. We do not have equal standing in our courts of law any more.

A 6-year-old California girl was removed from her long time foster family on Monday and will be sent to live with extended family in Utah who share her Native American heritage, according to court documents.
An appeals court said last week the girl was subject to removal from her foster family's home in Santa Clarita, north of Los Angeles, under the Indian Child Welfare Act, a federal law that seeks to keep American Indian children with American Indian families.
The child cried as Los Angeles County social workers carried her from the home on Monday, while dozens of supporters of the family lined the block to protest against the court's decision, the Los Angeles Daily News reported.
The child is 1.56 percent Choctaw Native American, NBC News and the Los Angeles Daily News reported. She has lived with her foster family for the past four years.

"With her own kind"? How does a 6 year old know her "own kind". How many of us white folks are 1/64 German or Irish or French or Swedish or freaking Russian and not know it? Would we be "better off with our own kind"?
