Because almost no one ever gets charged with this "crime". Its a misdemeanor. Look up Sandy Berger. No one has broken this law more flagrantly than him. He literally stole classified documents out of the National Archives by stuffing them into his socks, hid the documents, then destroyed the documents when the feds were on to him, then lied to the investigators about it. He was given 100 hours community service.

What do you think the punishment for such a crime would be? Take a guess. What do you think think the worst punishment he could possibly get for this crime? 10 years in prison? 20 years in prison?


If you want to know the truth, even if they found him with a metric ton of classified documents, he would never spend a day in jail. Its actually just misdemeanor. Seriously, no bullshit. Im as shocked by that fact as you probably are. :laugh:

People don't get sent to prison for a misdemeanor.

March 2015 – Retired U.S. Army General David Petraeus, a former CIA director, pleaded guilty to one count of unauthorized removal and retention of classified material. The plea followed revelations that Petraeus shared some of the materials with his biographer and mistress.

Petraeus was sentenced to two years of probation and a $100,000 fine.

First example ended as a misdemeanor, no jail time. The second example was a sentence for passing the information to unauthorized foreign entities.. Third example, once again a misdemeanor, no jail time.

Its doubtful you could even charge a president with this, let alone put him in a cell for it.

All of those are federal documents, and property of the government.

The question is, why did Trump feel a need to retain these documents? And what else did he retain that he shouldn't have.

Actually, if we are being honest, you dont even know that he had classified documents at all. By all reports, the FBI didnt find the evidence they were after. The safe was apparently empty. You have to actually find a crime before you can punish the man.
 
For a president, almost certainly no penalty. Legal experts are doubtful you could even charge a president with such a crime.

Interesting. Still, its extremely doubtful that you could charge a president with it. Presidents have the full legal authority to declassify documents at will.
