There would be a greater chance the court not legislating from the bench out of partisanship, 'cough, cough (Ginsberg)' and interpreting & applying the Constitution as they are intended to do. FDR threatened to expand it, ultimately it didn't happen. However he did get 5 nominations to change the court to his liking. Republicans would need 60 votes in congress to even have the opportunity, but I don't see it ever happening.
