It's the Refugee Act of 1980, which sets limits on the numbers of refugees to be accepted each year, and gives the President the sole authority as to who should be given such status.

The Constitution does so by giving Congress the power to create laws of naturalization, which they did - specifically, the Refugee Act of 1980.

The refugee act has only been around since 1948.

Actually, the Refugee Act has only been around since 1980. Prior to that, the acceptance of refugees was governed by international treaty.

The Supreme Court claimed the Constitution allowed FDR to round up American citizens based on national origin and place them in concentration camps.
