Actually it wasn't a stay, a stay prevents implementation of a lower court decision pending review by a higher court.

In this case the SCOTUS accepted a case out of the Court of Appeals for the D.C. Circuit, completed their review and ruled on the case itself. The decision as a reversal of the lower court ruling and the case was remanded back for proceedings that comply with the decision.

I don't see anything about the DC Circuit being told by the SC anything on the merits about the rules themselves, just that the SC said the rules couldn't be implemented until further review.

Maybe not a "stay" technically, but its still not a ruling on the merits of the case in the DC Circuit, just that the EPA can't make companies comply with the current timeline.

martybegan is correct this is a stay. However, the OP article is very poorly written, and the headline of the article even says the Supreme Court "overturns landmark EPA rule".

The EPA still has a chance to save the rule by correcting its cost-benefit analysis.

These changes to air quality were initiated by the EPA in 2008. The one in dispute went into effect in 2011.

So the lower court has to take cost into account, but the SC hasn't said anything else that would impact the D.C. Circuits decision.

If there is no Stay issued, what prevents the government from implementing the requirements?
