I don’t believe it uses the term “procedural due process.”Correct. And Due Process is in the Constitution 14th amendment and 5th for that matter. But, Substantive is not. Procedural is. Is it not? Substantive allows to insert personal beliefs or political leanings into the decisions instead of just deciding outcomes based on the laws written in the Constitution.
Only a terminally stupid judge would reach that conclusion based on the available evidence.Because I oppose her for other reasons, I don’t want to be misunderstood here. But the thread headline and the piece quoted are out of sync. Let’s be fair and honest about the judge’s position.
She appears to be contending that the reason to consider pedophiles more dangerous no longer makes as much sense since the availability of kiddie porn is no longer as restricted as it was prior to the internet. (I am not completely clear on why that matters, but she may have a point about how the change in technology has led to disparities in sentencing.)
Making such distinctions, or recognizing them, is part of a judge’s duties.

If the decisions are based solely on the words of the Constitution, Procedural is the only thing that can be done. So, it doesn't have to be in there. But, Substantive does or the words are changed by the changing of the meaning by the judge. For instance, Congress gave judges the time frame incarceration for convictions. Yet, Jackson removed the time frame for convicted Pedos by instead of issuing a 5 year sentence, she gave a perp a two-and-a-half year sentence. She re-wrote the law by doing so. I know judges are given discretion. I don’t know enough about the case to which you are making reference to form an opinion as to whether she usurped power. Overall, I wouldn’t doubt it. Such behavior is typical of liberals. And she is a liberal.

I'd say that none of them are substantive. But, instead of taking them as they are written, very cleanly I would say, that liberals have made it a mission of theirs to muddle what they are. The legislatures and Congress have the right to clarify. Or at least, try to. But, judges are simply to judge on the laws in each state and federal government.
