Texas Gay Marriage Ban Ruled Unconstitutional By Federal Judge

02/27/2014

U.S. District Judge Orlando Garcia ruled Wednesday that Texas' ban on same-sex marriage is unconstitutional.

Garcia issued a preliminary injunction on the state's ban, citing Supreme Court precedent. However, Garcia issued a stay on his order, meaning the ban will remain in effect pending appeal.

“Today’s court decision is not made in defiance of the great people of Texas or the Texas Legislature, but in compliance with the U.S. Constitution and Supreme Court precedent,” Garcia wrote in the order. “Without a rational relation to a legitimate governmental purpose, state-imposed inequality can find no refuge in our U.S. Constitution.”

You do realize of course that a lower court cannot contradict the US Supreme Court's findings last June, don't you? The US Supreme Court found that each of the several states have the "unquestioned authority" via a consensus, to determine whether or not gay marriage is legal within their boundaries, "as the Framers of the Constitution intended" retroactive to the founding of the country. ie, the states' individual consensuses were found to be superior to judicial or legislative fiat.

These lower court judges are in contempt of the US Supreme Court Ruling in Windsor. Read it.

Former media adviser to President George W. Bush, Mark McKinnon: “I’ve long believed as a Republican that opposition to gay marriage is philosophically inconsistent for a party that is supposed to support less government intrusion into our lives,”

Marriage equality advocates fly South, and not just for winter | MSNBC 02/26/14

The campaign will focus on Alabama, Arkansas, Florida, Georgia, Kentucky, Louisiana, Mississippi, North Carolina, Oklahoma, South Carolina, Tennessee, Texas, Virginia and West Virginia. According to a December 2013 poll from Anzalone Liszt Grove Research, 46% of voters in the South said they favored marriage equality, while the same number – 46% – said they were opposed. Though it was the weakest region in the country in terms of support for same-sex marriage, Wolfson noted the results from the South were “certainly higher than most people would think.”

Good on you for exposing your feelings about LGBT Americans, at least you're not a closeted bigot like so many Republicans but-----but even the formerly solid South is close to joining the rest of the country by coming out in favor of marriage equality.
