If you are prosecuted and convicted, the criminal statute for refusal to comply with a congressional subpoena before the committee of either House can result in the following punishment:

  • Fined not more than $1,000, but not less than $100 AND
  • Imprisonment in a common jail for at least one month, but not more than 12 months

The fine was for contempt of court. Apparently the court has discretion.

Nice try at a dodge. But wrong. The subject of the referral for contempt of Congress was the AG himself. Accordingly, he and the DOJ were conflicted and an impartial special prosecutor should have been appointed to make the determination about what to do with the referral.

Your proposal is AG Holder or one subordinate and answerable to AG Holder could legitimately make a call about whether to prosecute AG Holder. Pretty good gig if you can get it.

Peter Navarro, an economic adviser to former President Donald Trump, has been indicted by a federal grand jury on two counts of contempt of Congress for failing to comply with a subpoena issued by the House Select Committee investigating the Jan. 6, 2021, attack on the U.S. Capitol, the Justice Department announced Friday.
Navarro, 72, was charged with one contempt count involving his refusal to appear for a deposition and another involving his refusal to produce documents despite a subpoena from the committee, the Justice Department said.
Each count carries a minimum of 30 days and a maximum of one year in jail, as well as a fine of up to $100,000.

Well now, it seems that Navarro will become the first to test if he is above the law. I do hope that those members of Congress will feel they too are above the law!

Notice what’s missing? That’s right. Any reference to any hint of a concern with clarification of the electoral certification procedures or laws.
SEC. 3. PURPOSES.
(1) To investigate and report upon the facts, circumstances, and causes relating to the January 6, 2021, domestic terrorist attack upon the United States Capitol Complex ...as the influencing factors that fomented such an attack on American representative democracy while engaged in a constitutional process.

If the cause of the attack was to stop the count. The reason for stopping of the count is within Section 3 authority.

Actually the decision of the DC Circuit said the committee was legitimate (specifically ruled that their purpose was legitimate)

That argument is no longer available in the D.C. Circuit with respect to the Jan. 6 Committee.

The DC circuit ruled the committee's purpose was legitimate. Which means the committee is also legitimate.

Being above the law or not is going to depend on Trump's power going forward in America. No criminal behaviour by Trump or his sympathizers will be charged if Trump still holds the power to being about a revolution.

Trump could be unstoppable, at least by any legal means used against him by the law.
