Washington police are operating under orders to arrest tourists and other non-residents traveling with spent bullet or shotgun casings, a crime that carries a $1,000 fine, a year in jail and a criminal record, according to a new book about the city's confusing gun laws.

"Empty shell casings are considered ammunition in Washington, D.C., so they are illegal to possess unless you are a resident and have a gun registration certificate," pens Emily Miller in her investigative book, "Emily Gets Her Gun: ... But Obama Wants to Take Yours."

Under the law, live or empty brass and plastic casings must be carried in a special container and unavailable to drivers. Having one, for example, in a cup holder or ash tray is illegal.

She told Secrets that the police are "under orders to arrest tourists or other legal gun owners from out of state who wouldn't think to empty brass and plastic from their cars or pockets."

In her newly debuted book about the difficulty getting a gun in Washington, known for tough anti-gun laws, D.C. Police provided Miller with a copy of a recent "roll call" advisory that tells cops to overlook spent casings in the cars and trucks of city residents who have their gun registration certificate with them when detained, despite the law.​

Why are people walking around D.C. with empty bullet casings? Did they accidentally leave them in their pocket when they stepped on the Metro from VA?
 
Its a silly law/rule/ordinance and certainly an example of government overreach. That such exists is yet another reason not to visit or go near Mordor on the Potomac. Yet it begs the question....

Other than novelty keyrings....who walks around with spent brass in their pocket?
 
DC is mostly concrete so carrying empty casings means you just fired a weapon and gun deaths in DC are high.

Not always. I have a bucket full of empty casings. Does that mean i'm tampering with evidence of a crime? No...it means i'm policing my brass after i spend half an afternoon target shooting.

This law is bullshit, plain and simple. It stinks of nothing but Police State laws.

Plus, there's the matter of there being no actual evidence that the law exists. The article was simply uncritically repeating someone else's claims. Maybe the law exists, maybe it doesn't, but the reality-based community doesn't take things on faith, and requires more than the claim of one activist.

Naturally, being part of the reality-based community, I looked at the DC criminal code, trying to find the law.

I read the entries in "CHAPTER 45. WEAPONS AND POSSESSION OF WEAPONS". I didn't see any mention of empty bullet casings being illegal. Searching the whole code on the word "casing" or "shell" turns up no such law. The law doesn't seem to exist.

And that would be what has the usual suspects in panic today. If they want to claim the law exists, they need to point to where it is in the DC Code. Otherwise, they should feel ashamed for having played the part of UsefulIdiot again.

I'd bet that many shooters put used brass in their jacket pockets and then simply forget about it. Fates know I have! I know my uncle has.
