Yes. That was the point of changing the penal code. Didn't you get the memo?If we can't differentiate between the two then all abortions should be considered first degree murder.

So is the fetus a person or not?
A judge can rule on anything he or she wants. What's stopping them?
It is a person but not a passenger.
Oh they still do that here.We used to have that in my state. I don't know of any place that still does that. It was mandated by city instead of the entire state, so customers who needed alcohol for a party or whatever would simply go to the next city that sold alcohol on Sunday, and they all quit doing it after a while.
The citation is not the opinion the opinion is the officer telling her he believes the citation would be dropped if she fought it.
Which is what this lady is saying, and that inconsistency should get her out of a ticket.
How is she not a passenger?
She is riding in a vehicle, but she is not the one who is operating that vehicle. That makes her a passenger, even if she happens to be inside of the person who is operating the vehicle.
Good point, just look at SCOTUS
Isn't that what Texas wants?
Did she have the infant in a child safety seat?
Yes, they did.Did they do that?
Yes, they did.
True. You cannot charge a pregnant woman who drinks with child abuse. Dumb question. Dumb thinking.
She did not get a ticket for that, so it is irrelevant...unless of course you say that the baby in the womb does not count at "people"
That was the intent of changing the penal code to consider fetuses as persons. Do you deny it?They did? Abortions are now considered first degree murder in Texas?
I agree, they should dismiss the HOV ticket and replace it with a no car seat ticket.
Except the fetus was properly secured.
You can't secure a baby without a car seat.
