I think this is where having 2 corporate lawyers on the jury helps Trump. They may not know criminal law, but they understand the need to prove every element of the charge.

They also know that personal records are not business records...

If he lets it go the jury, I'm still holding out hope for a directed verdict, the jury instructions will be critical. The judge is going to have to lay out what he thinks the defendant has been charged with and what the prosecution is required to show, beyond a reasonable doubt.

I think you misunderstood my post. The jury is the finder of fact, and the appellate courts accept the facts that the jury finds true. There are lots of bad witnesses in trials, and it is up to the defense to show their flaws to the jury. Trump's lawyers have done this and will continue to impeach Cohen on Thursday.

After a guilty verdict is reached, and the sentence is handed down, a defendant can appeal. The appeals court will look at the judge's rulings, both on pre-trial motions, and any complaints from the defense on the way the trial was conducted. If they find the defendant was afforded due process, and there were no errors of law, the verdict will stand.

Whatever the bias of the witnesses, if the trial jury finds the witness credible, the appellate court cannot say otherwise. It's not their role.

The jury instructions will say it all. The charge is the falsification of records, there is no ambiguity there. What he tells the jury they have to find in order to reach a guilty verdict, is what matters.

Well, he is also going to have to explain to them what the "other crime" is that Bragg used to boot it up to a felony. The loons here still think it's campaign finance crime.

That literally Cohen fabricated the entire story(which the DA wanted him to do)...that he is lying to stay out of jail for the crimes he did do. He, Cohen, did all the falsification without Trump knowing anything about any of it so Cohen could get himself off the hook for his many misdeeds of lying under oath to congress. Court. His bank, and just about everyone who asked him a question.

So you can't tell us, in plain English, what the underlying crime is....Because if you could, you'd cite the exact place in that heap of nothing where said criminal act is spelled out.

The judge has to explain every element of the charged offense, and intent to conceal an underlying crime is one of those elements.

It does not necessarily mean the judge has to identify the specific underlying crime- he allowed 3 theories to the prosecution, and he may allow the jury to select from those 3- I don't know the answer to that question.

The prosecution may identify it in their closing arguments. They already told it to the judge in sidebar and said their entire case rests on a "conspiracy to influence the election". Their entire case has been to try to construct a conspiracy, so the election law is the likely candidate for sure.

Have you seen transcript of the call between Davidson and Cohen? This was either just before or just after the FBI raided Cohen's home and was investigating the NDA.

(Davidson had just been told by his bank that someone was looking at the transfers in his client trust account, and he called Cohen to give him a heads-up.)

Davidson tells Cohen how Stormy was furious it was taking so long to settle...
