If the NDA was filed to protect the image of the TRUMP organization, then it would be a legitimate business expense. If Trump had sex with Stormy on behalf of his role as Chief Executive, then it would be a legitimate payment.

But Trump had sex with her as a private citizen and was concerned with his personal reputation

Trump has countered with …he never had any sex with Stormy, never was aware of any payments and paid Cohen general retainer fees.
