If they were trying to pull a fast one, they would have remained silent and when the democrats tried to list Biden, just said so sorry, too late by Ohio law, you missed the deadline. If things were reversed, I’m sure that is what a democratic SoS would have done.

Name ONE person who has been charged with insurrection. It is a specific crime. Here is the US Code section:
"The prohibition on rebellion and insurrection arises in federal law at 18 U.S.C. Section 2383. The law prohibits incitement, assistance, and participation in a rebellion or insurrection against the authority of the United States and its laws."
Not a single person has been charged under 18 USC 2383.
